These Terms of Service (the "Terms") are a binding contract between you and PT NAKAFA TEKNO KREATIF ("Nakafa," "we," "us," or "our"). These Terms govern your access to and use of our websites, applications, and related services (collectively, the "Services").
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Your use of the Services is also subject to our Privacy Policy.
Nakafa is an educational platform that provides structured learning content and interactive features. The Services include AI-powered features that generate outputs based on prompts you submit.
You must be at least 13 years old to use the Services.
If you are under 18 years old, you may use the Services only with the permission and involvement of a parent or legal guardian, who must agree to these Terms on your behalf.
AI features have a separate age requirement. You must be at least 18 years old and meet any higher minimum age required by the law where you live to use AI features.
You may not use the Services if your use is prohibited by applicable law.
You may need an account to access certain features. When you create an account, you must provide accurate information and keep it up to date.

We may implement device and session security measures (for example device-based security records and session controls) to protect accounts and reduce fraud and abuse.
You agree to use the Services only for lawful purposes and in accordance with these Terms.

We may suspend or terminate access if we believe you have violated these Terms or if your behavior creates risk for the Services, other users, or third parties.
If you use AI features, you submit prompts or messages and the Services generate outputs. Nakafa routes prompts and related context through Vercel AI Gateway to Gemini 3.5 Flash Lite or Gemini 3.7 Flash. The Gateway may select Google or Google Cloud Vertex AI, but no other model provider is permitted. Each request requires a route that Vercel identifies as disallowing prompt training. If no eligible Google or Vertex AI route is available, the request fails. No other provider receives it. Research features may also use Google Search grounding to corroborate public information.
Our use of these services is subject to the Vercel AI Product Terms, Vercel Notices and License Information, Gemini API Additional Terms, and Google Cloud Terms, as applicable to the selected route.
AI outputs may be inaccurate, incomplete, or inappropriate. You are responsible for verifying any output before relying on it, including in educational, professional, medical, legal, or financial contexts.
Do not include sensitive personal data in prompts (for example government IDs or payment card numbers). You are responsible for the content you submit.
Certain features may require a paid Subscription.
Polar Software, Inc. ("Polar") acts as the merchant of record and authorized reseller for purchases made through Polar checkout. Your purchase and payment contract is with Polar under its Buyer Terms. These Terms continue to govern your use of Nakafa.
When you complete checkout, you authorize Polar to charge the payment method you provide for the displayed Subscription price, applicable taxes, and any disclosed renewal charges until you cancel.
Unless otherwise stated at checkout, Subscriptions renew automatically until canceled. You can cancel through the Polar customer portal or as otherwise described in Polar's Buyer Terms.
If you cancel, access to paid features continues until the end of the current billing period, unless otherwise stated at checkout.
Polar processes charges, cancellations, refunds, and applicable taxes under its Buyer Terms and mandatory law. Nakafa does not independently charge your payment card or issue payment refunds. We will help you identify the correct Polar support route.
Nothing in these Terms limits a mandatory consumer right of withdrawal or refund. If EU or EEA consumer law applies to your distance contract, you may have 14 days to withdraw without giving a reason. Starting access during that period does not remove the right unless every requirement under applicable law, including any required express request and acknowledgement, has been satisfied. We may change pricing or plans over time. If changes apply to your Subscription, we will provide notice through the Services or another legally valid contact method, and the change will apply no earlier than your next renewal, unless otherwise required by law.
When a new account is created, the current account workflow schedules a welcome email and sends it through Resend.
The Services, including our content, software, design, and trademarks, are owned by Nakafa or our licensors and are protected by intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Services or included content unless you have our prior written permission or such activity is permitted by law.
Some Nakafa source code is publicly visible for review and contribution. Public source visibility does not grant permission to rebrand, redistribute, host, modify, sell, monetize, scrape, train AI models on, or turn Nakafa into another product. Repository materials are governed by the applicable repository license and policies, including the Nakafa Source Available License, Nakafa Content License, and Nakafa Trademark and Brand Policy.
You retain your rights in User Content you submit.
By submitting User Content, you grant Nakafa a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process your User Content solely to operate, improve, and provide the Services, including processing prompts to generate AI outputs.
You represent that you have the rights necessary to submit User Content and that your User Content does not violate applicable law or the rights of others.
The Services rely on third-party services to operate. These may include:
Third-party terms and privacy notices may also apply when you interact with those services. Nothing in this section excludes responsibility that Nakafa has under mandatory law.
The Services are provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Nakafa will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses, arising out of or related to your use of the Services.
To the fullest extent permitted by law, Nakafa’s total liability for any claims arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us for the Services in the 12 months before the event giving rise to the claim, or (b) USD $100 (or the equivalent in your local currency).
This limitation does not apply to liability that cannot be limited under applicable law.
If you use the Services on behalf of a business or organization, that entity is responsible for your use. To the extent permitted by law, the entity will defend and indemnify Nakafa against third-party claims caused by its unlawful User Content or intentional violation of these Terms. This section does not apply to consumers where such an obligation is prohibited or limited by mandatory law.
You may stop using the Services at any time.
We may suspend or terminate your access to the Services if we believe you violated these Terms, if required to comply with law, or if your use creates risk or harm to the Services, other users, or third parties.
Upon termination, your right to use the Services will stop immediately. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, business-user claims, and dispute resolution.
These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict of law principles.
Except where prohibited by applicable law, you and Nakafa agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the courts of the Republic of Indonesia, and you consent to personal jurisdiction in those courts.
If you are a consumer, this choice does not deprive you of mandatory protections or access to courts that cannot be excluded under the law of your habitual residence.
We may update these Terms from time to time. If we make material changes, we will provide notice through the Services or by other reasonable means before the changes take effect.
Where law requires your consent to a change, we will ask for it. Otherwise, continued use after the effective date constitutes acceptance only to the extent permitted by law. If you do not agree, you must stop using the affected Services before that date.
