These Terms of Service (the "Terms") are a binding contract between you and PT NAKAFA TEKNO KREATIF ("Nakafa," "we," "us," or "our"). These Terms govern your access to and use of our websites, applications, and related services, including Nakafa School (collectively, the "Services").
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Your use of the Services is also subject to our Privacy Policy.
Nakafa is an educational platform that provides structured learning content and interactive features. The Services include AI-powered features that generate outputs based on prompts you submit, and Nakafa School for Schools.
You must be at least 13 years old to use the Services with a personal account.
If you are under 18 years old, you may use the Services only with the permission of a parent, legal guardian, or teacher. When you sign in, you accept these Terms and our Privacy Policy and confirm that you have that permission.
AI features, including Nina, have no separate age requirement and are also available in Nakafa School.
In Nakafa School, the School decides which of its students receive accounts, including students under 13, and the School is responsible for arranging the consent of parents or guardians that the law requires. Where the School uses the Guardian consent flow, Nakafa records that consent as our Privacy Policy describes.
You may not use the Services if your use is prohibited by applicable law.
You may need an account to access certain features. When you create an account, you must provide accurate information and keep it up to date.

If a School created your account, the School manages it, including its username and password, and your use of it is also subject to the School's rules.
We may implement device and session security measures (for example device-based security records and session controls) to protect accounts and reduce fraud and abuse.
You agree to use the Services only for lawful purposes and in accordance with these Terms.

We may suspend or terminate access if we believe you have violated these Terms or if your behavior creates risk for the Services, other users, or third parties.
If you use AI features that generate content, such as Nina, you submit prompts or messages and the Services generate outputs. Nakafa routes Nina's prompts and related context through the Convex AI gateway to Claude Haiku 5.5, a model that Anthropic makes. The same gateway also serves a decision model, which Nina uses to decide what to remember, and an embedding model, which Nina uses to find lessons. Claude Haiku 5.5 is the only language model that Nakafa uses for Nina. Convex selects how each request is served and states that it routes only to providers under a zero data retention agreement. Research features also use Firecrawl to search the web and read pages.
Our use of these services is subject to the Convex Terms of Service, Anthropic's Commercial Terms of Service, the Gemini API Additional Terms, and the terms of the cloud that serves a request, such as the Google Cloud Terms, the AWS Service Terms, or the Microsoft Product Terms, as applicable to the route Convex selects.
AI outputs may be inaccurate, incomplete, or inappropriate. You are responsible for verifying any output before relying on it, including in educational, professional, medical, legal, or financial contexts.
Do not include sensitive personal data in prompts or free-text answers (for example government IDs or payment card numbers). You are responsible for the content you submit.
Google connectors are not available yet, and this section applies from the day they become available. If you connect a Google service, such as Google Drive, Google Forms, Google Classroom, or Google Calendar, you authorize Nakafa to access the Google data that our Privacy Policy describes for the features you use. Connect only accounts and data you are allowed to use. If a School or another organization manages your Google account, its rules apply, and its administrator may limit what you can connect. A School administrator can also turn connectors off for particular roles in Nakafa School. Google's terms continue to govern your Google account. You can disconnect a connector at any time.
A School uses Nakafa School under a written agreement with Nakafa. That agreement sets the School's plan, fees, and modules, includes a data processing agreement for School Data, and licenses the Nakafa content the School may use. If these Terms conflict with that agreement on the School's use of Nakafa School, the agreement prevails.
The School decides who joins its space in Nakafa School and with which role, such as administrator, teacher, student, or Guardian. The School is responsible for the people it invites or creates accounts for, the roles it assigns, the content it uploads, and the instructions it gives Nakafa about School Data. Teachers and staff use Nakafa School on the School's behalf.
Nakafa School and the following of its features are not available yet: accounts that a School creates for students, assignments, assessments, grades, and report cards, exam misconduct flags, labels that mark a question as public, AI drafts for report cards and progress summaries, the narratives Guardians see, and the Guardian consent flow. The statements about them apply from the day each feature becomes available.
A School can create username accounts for its students. The School manages these accounts and their credentials, and a student uses such an account for the School's learning and assessments.
Nakafa content, including lessons, articles, and try-out questions, is licensed under the Nakafa Content License, which allows personal, non-commercial learning without written permission. Using that content in a school program, a learning management system, or a question bank requires Nakafa's prior written permission, so a School may use Nakafa content in Nakafa School only as its written agreement licenses it. Questions from Nakafa's public question bank are open to everyone, so students may have seen them before. Nakafa School labels these questions as public, and the School decides whether to use them in an exam.
In Nakafa School, AI output is a suggestion. Other AI features can draft report card descriptions and summarize progress, but a teacher reviews and decides every exam grade before it is released, and teachers approve report cards and the narratives Guardians see.
Nakafa School can detect and flag signs of exam misconduct, such as leaving the exam page, but a web page cannot lock a device. The School decides how to respond to a flag.
Report cards and other documents that a School issues through Nakafa School are the School's documents, and the School is responsible for their content. Nakafa does not issue official diplomas.
Certain features may require a paid Subscription. A School pays for Nakafa School under its written agreement with Nakafa.
Polar Software, Inc. ("Polar") acts as the merchant of record and authorized reseller for purchases made through Polar checkout. Your purchase and payment contract is with Polar under its Buyer Terms. These Terms continue to govern your use of Nakafa.
When you complete checkout, you authorize Polar to charge the payment method you provide for the displayed Subscription price, applicable taxes, and any disclosed renewal charges until you cancel.
Unless otherwise stated at checkout, Subscriptions renew automatically until canceled. You can cancel through the Polar customer portal or as otherwise described in Polar's Buyer Terms.
If you cancel, access to paid features continues until the end of the current billing period, unless otherwise stated at checkout.
Polar processes charges, cancellations, refunds, and applicable taxes under its Buyer Terms and mandatory law. Nakafa does not independently charge your payment card or issue payment refunds. We will help you identify the correct Polar support route.
Nothing in these Terms limits a mandatory consumer right of withdrawal or refund. If EU or EEA consumer law applies to your distance contract, you may have 14 days to withdraw without giving a reason. Starting access during that period does not remove the right unless every requirement under applicable law, including any required express request and acknowledgement, has been satisfied. Submit payment and withdrawal requests through Polar as the merchant of record. You may also contact nakafaai@gmail.com for help.
We may change pricing or plans over time. If changes apply to your Subscription, we will provide notice through the Services or another legally valid contact method, and the change will apply no earlier than your next renewal, unless otherwise required by law.
When a new account is created, the account workflow prepares a welcome email, and after you complete onboarding, Nakafa sends it through Resend. In Nakafa School, Nakafa also sends invitations by email. Sign-in codes for Guardians and notifications about School activity are not available yet. Nakafa does not send messages through WhatsApp.
The Services, including our content, software, design, and trademarks, are owned by Nakafa or our licensors and are protected by intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Services or included content unless you have our prior written permission or such activity is permitted by law.
Some Nakafa source code is publicly visible for review and contribution. Public source visibility does not grant permission to rebrand, redistribute, host, modify, sell, monetize, scrape, train AI models on, or turn Nakafa into another product. Repository materials are governed by the applicable repository license and policies, including the Nakafa Source Available License, Nakafa Content License, and Nakafa Trademark and Brand Policy.
You retain your rights in User Content you submit.
By submitting User Content, you grant Nakafa a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process your User Content solely to operate, improve, and provide the Services, including processing prompts to generate AI outputs.
You represent that you have the rights necessary to submit User Content and that your User Content does not violate applicable law or the rights of others.
In Nakafa School, the School's written agreement also governs the content that the School and its users upload.
The Services rely on third-party services to operate. These may include:
Third-party terms and privacy notices may also apply when you interact with those services. Nothing in this section excludes responsibility that Nakafa has under mandatory law.
The Services are provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Nakafa will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses, arising out of or related to your use of the Services.
To the fullest extent permitted by law, Nakafa’s total liability for any claims arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us for the Services in the 12 months before the event giving rise to the claim, or (b) USD $100 (or the equivalent in your local currency).
This limitation does not apply to liability that cannot be limited under applicable law.
If you use the Services on behalf of a business or organization, that entity is responsible for your use. To the extent permitted by law, the entity will defend and indemnify Nakafa against third-party claims caused by its unlawful User Content or intentional violation of these Terms. This section does not apply to consumers where such an obligation is prohibited or limited by mandatory law.
You may stop using the Services at any time.
We may suspend or terminate your access to the Services if we believe you violated these Terms, if required to comply with law, or if your use creates risk or harm to the Services, other users, or third parties.
If a School removes you from its space, or its agreement with Nakafa ends, you lose access to that School's spaces, and School Data follows the School's instructions.
Upon termination, your right to use the Services will stop immediately. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, business-user claims, and dispute resolution.
These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict of law principles.
Except where prohibited by applicable law, you and Nakafa agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the courts of the Republic of Indonesia, and you consent to personal jurisdiction in those courts.
If you are a consumer, this choice does not deprive you of mandatory protections or access to courts that cannot be excluded under the law of your habitual residence.
We may update these Terms from time to time. If we make material changes, we will provide notice through the Services or by other reasonable means before the changes take effect.
Where law requires your consent to a change, we will ask for it. Otherwise, continued use after the effective date constitutes acceptance only to the extent permitted by law. If you do not agree, you must stop using the affected Services before that date.
